DMCA Copyright Policy
MakeOurs respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedure for addressing copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).
1. How to File an Infringement Notice (DMCA Notice)
If you believe that a website built using MakeOurs infringes upon your copyright, you may submit a formal DMCA Notice. To be effective, your notice must be in writing and include the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are involved).
- Identification of the material claimed to be infringing and information reasonably sufficient to locate the material (e.g., the specific site URL).
- Your contact details, including your address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
2. MakeOurs Action on Valid Notifications
Upon receipt of a valid, complete DMCA Notice containing all the required information listed in Section 1, MakeOurs will take the following steps:
- Expeditiously remove or disable public access to the allegedly infringing material.
- Notify the site creator associated with the account that access to the material has been disabled.
- Provide the site creator with a copy of the DMCA Notice so they understand the nature of the claim and have the opportunity to respond.
3. Counter-Notification Procedure
If your site content was removed or disabled due to a DMCA claim and you believe this was a result of a mistake or misidentification, you may submit a Counter-Notification. Your Counter-Notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or disabled and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the competent courts in India, and that you will accept service of process from the person who provided the original DMCA Notice.
4. Repeat Infringer Policy
MakeOurs is committed to protecting intellectual property rights and maintaining a clean ecosystem. In accordance with the DMCA and other applicable laws, we maintain a strict Repeat Infringer Policy. If a user is found to have repeatedly uploaded infringing materials or has received multiple valid DMCA notices against their account, MakeOurs reserves the right to terminate their account, cancel active subscriptions, and disable all associated sites built on the platform.
5. Designated Copyright Agent & Submissions
