Terms of Service

To access and use MakeOurs, you must register for an account:

• Account Security: You are responsible for safeguarding your login credentials and preventing unauthorized access. You are liable for all activities occurring under your account.
• Acceptable Use Policy: You agree not to use MakeOurs to build sites containing, promoting, or linking to illegal content, malware, hate speech, spam, or infringing material. We reserve the right to suspend any account that violates these terms.
• Prohibited Content & Content Policy: MakeOurs will not generate or host a site for certain categories of business or content, regardless of how the request is phrased, including any claim that it is legal. This includes:
  • Child Safety & Exploitation: Content sexualizing minors, child grooming, or child trafficking.
  • Non-Consensual Sexual Content: Material built on trafficking, coercion, voyeurism, or "revenge porn".
  • Adult Content & Services: Pornography or other sexually-explicit-content businesses, escort, or prostitution services (legal retail such as lingerie, adult novelties, or sex-education content is not covered by this restriction).
  • Illegal Goods & Services: Drugs, weapons/explosives, counterfeit goods, hacking, malware-for-hire, stolen data, human trafficking, or unlicensed financial schemes.
  • Violence & Hate: Direct incitement to violence, terrorism support, or hate-group recruitment.
  Site generation requests that fall into any of these categories will be automatically rejected. We reserve the right to immediately suspend or terminate any account that attempts to use MakeOurs for such purposes, without refund, at our sole discretion.

Certain features of MakeOurs require a paid subscription:

• Billing & Renewals: Subscriptions are billed in advance on a recurring monthly or annual cycle and are processed securely through Razorpay. You agree to provide valid billing information.
• Cancellations & Refunds: You can cancel your subscription at any time. Cancellations and eligibility for refunds are governed strictly by our separate Refund Policy.

Ownership of content and technology is divided as follows:

• User Content Ownership: You retain complete ownership of all design inputs, copy texts, images, and brand materials you upload. You grant MakeOurs a non-exclusive license to host, transmit, and display this content to deliver your website.
• Stock Media Attribution: Public stock media (such as images from Unsplash or Pexels) sourced during site generation remain subject to their respective licenses. Intellectual property of these assets is credited to their original creators and is not owned by the site creator.
• MakeOurs Proprietary Rights: The underlying code, editor tools, designs, templates, and AI algorithms are the exclusive property of MakeOurs and are protected by global intellectual property laws.

Please review these limitations of liability carefully:

• "As Is" Service: MakeOurs is provided on an "AS IS" basis. We do not guarantee uninterrupted service, error-free operations, or absolute data persistence.
• Data Loss Disclaimer: We are not liable for accidental data loss, hosting outages, or loss of access to site configurations due to payment defaults or subscription cancellations. You are responsible for keeping local backups of your design assets.
• Limitation of Liability: To the maximum extent permitted by law, MakeOurs and its operators will not be liable for any indirect, incidental, or consequential damages arising from your use of or inability to use the platform.

• Indemnification: You agree to indemnify, defend, and hold harmless MakeOurs, its owners, employees, contractors, affiliates, and service providers from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your website content, your business activities, or your violation of these Terms, to the fullest extent permitted by applicable law.
• Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
• Dispute Resolution: Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Moradabad, Uttar Pradesh, India.
